Obtain NPDES Construction General Permit coverage and file an electronic Notice of Intent before clearing/grading one acre or more

Steps

1. Confirm EPA (not a state) is the CGP-issuing authority for the project location, since most states run their own delegated construction stormwater permit instead of the federal 2022 CGP
2. Develop a Stormwater Pollution Prevention Plan (SWPPP) covering erosion/sediment controls before land disturbance begins
3. Register for and submit the Notice of Intent (NOI) electronically through EPA's NPDES eReporting Tool (NeT), as required by the NPDES Electronic Reporting Rule
4. Post the required site signage and maintain SWPPP documentation on-site for inspection
5. Implement and document stabilization measures per CGP timelines once clearing/grading in an area is complete or paused
6. File a Notice of Termination through NeT once final stabilization is achieved
