Steps
Have a qualified inspector survey the structure for regulated asbestos-containing material (RACM) per 40 CFR 61.145(a), regardless of the structure's age.
File the Asbestos NESHAP 'Notification of Demolition and Renovation' with the delegated state/local air agency (or EPA region if undelegated) at least 10 working days before demolition begins, per 40 CFR 61.145(b).
Include facility description, estimated RACM quantity, start/end dates, and waste transporter/disposal site on the notification, and retain proof of postmark/delivery date.
If demolition is ordered by a government agency due to imminent structural collapse, notify as early as possible but no later than the following working day, and keep the order on file.
Remove friable RACM using wet methods and proper disposal before load-supporting structural members are demolished, independent of the notification timeline.
Known gotchas
The 10-working-day clock runs from receipt by the delegated state/local agency, not EPA headquarters — confirm which agency actually has jurisdiction over the site.
The notification is required for essentially all demolitions of the covered structure type regardless of whether asbestos is found — 'none found' does not exempt the filing.
