Steps

  1. Determine jurisdiction first: for projects anywhere in New York State OUTSIDE New York City, notify the NYS Department of Labor (DOL) Asbestos Control Bureau; for projects INSIDE New York City, notify NYC DEP instead — the two are separate agencies with separate forms
  2. For NYS DOL projects, file the Asbestos Project Notification (Form SH-483) at least 10 days before work starts when the project exceeds 260 linear feet or 160 square feet of ACM, via mail, fax, or the asbestosnotification@labor.ny.gov email channel listed on dol.ny.gov
  3. For NYC projects, prepare the ACP-7 (Asbestos Project Notification) through NYC DEP's online Asbestos Reporting and Tracking System (ARTS)/eFiling, at least 10 days before starting abatement, including survey and chain-of-custody documentation
  4. Use the NYC DEP ACP Search Portal (a826-web01.nyc.gov/acpsearchportal) to look up prior ACP-7/ACP-5 filings for a given property before assuming no filing history exists
  5. Verify current abatement contractor licensure against the NYS DOL asbestos handling certification database before listing a contractor on either filing
