Determine when a California Record of Survey must be filed under the Professional Land Surveyors Act

Steps

1. Pull current text of California Business and Professions Code §8762 (and related Article 5 sections) from leginfo.legislature.ca.gov to confirm the filing triggers, since surveying-practice statutes are periodically amended by the legislature.
2. Determine if a Record of Survey is mandatory: it is required when the field survey discloses material evidence or a physical change not shown on any previously recorded/filed subdivision map, official map, record of survey, or BLM survey record — or when it reveals a material discrepancy with such prior records.
3. If no mandatory trigger applies, decide whether to file voluntarily; a licensed surveyor or civil engineer may still elect to file a record of survey with the county surveyor after any field survey performed in conformity with land-surveying practice.
4. Prepare the Record of Survey per the Act's content requirements and file it with the county surveyor within the statutory deadline — 90 days after setting boundary monuments during the field survey, or 90 days after completing the field survey, whichever occurs first.
5. After county surveyor examination, ensure the map is transmitted to and filed with the county recorder to complete the public record.
